                   AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS
                   AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS
                   TO REZONE A TRACT OF LAND LOCATED AT 2318 EAST
                   3RD STREET, BEING ON THE SOUTHWEST LINE OF EAST
                   3RD STREET AT DERBY CIRCLE FROM R-2 RESIDENTIAL
                   ZONE TO C-2 CONVENIENCE COMMERCIAL ZONE,
                   SUBJECT TO CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as
         amended, known as the Zoning Ordinance, be and the same is 
hereby
         amended so as to rezone:
               
                A tract of land located at 2318 at East 3rd Street,
                being on the southwest line of East 3rd Street at
                Derby Circle.  Lot 4, block 12, Glenwood Addition
                No. 2, as shown by plat of record in plat book 9,
                pages 30 and 31, ROHC; being the property described
                in deed book 2352, page 425, ROHC.  Tax Map No.
                146F-X-4.
               
               
         from R-2 Residential Zone to C-2 Convenience Commercial Zone.
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this rezoning 

         shall be subject to the following conditions:
        
              1.   Subject to proposed use only.
        
              2.   Subject to access to 3rd Street only.
        
              3.   Subject to a sight-obscuring landscaped screen along
                   Derby Circle and the south property line in 
accordance
                   with the provisions of the proposed Landscape 
Ordinance.
        
              4.   Subject to 50 foot setback from Derby Circle with no
                   parking access or use other than landscaping within 
50
                   foot setback.
        
              5.   All existing easements are retained.
        
        
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage, the 
public
         welfare requiring it.
